When an immigrant receives a "Notice to Appear" in immigration court or is arrested for an alleged criminal charge, it can be a very traumatic time in his or her life. For many the thought of being deported and potentially everything he or she has worked so hard to achieve can be very hard to deal with.

Seeking the advice and representation of experienced legal counsel who is well versed in immigration law and proper legal procedure. In every deportation case, there may be one or more potentially successful defense strategies.

Depending upon the circumstances of your deportation case, some of the strategies that may be available for deportation defense include, but are not limited to:

  • Cancellation of removal order;

  • Motions to reopen deportation proceedings;

  • Adjustment of status applications to fix unlawful presence allegations;

  • Requests for asylum, withholding of deportation, and torture under the Geneva Convention;

  • Waivers;

  • Appeals of deportation orders.

An immigrant may be singled out for deportation for a number of reasons, including, but not limited to:

  • People who have fraudulently become citizens of the country, such as by marrying a citizen of the United States for the purpose of becoming a legal citizen. If the marriage is legitimate, no fraud has taken place, but if the marriage was a rouse, deportation may be the solution.

  • People who have come to the country legally on a temporary basis and then have refused to depart when the reason was no longer valid. For example, people can travel to the United States on a work or education visa, but once the visa expires, if they do not return home or renew the visa, they are eligible for deportation.

  • People who sneak into the country illegally. Traveling into the country by crossing a border or flying in, and then masquerading as a legal citizen is cause for deportation. While it is legitimate to visit the United States, people who reside here on a long term basis without any legal right can be deported.

  • People who have been arrested, charged or convicted of certain crimes; or it is found that the immigrant who is in the United States legally is wanted in a treaty country for an aggravated felony crime they have committed, such as rape, murder, or drug trafficking.

  • Threat of terrorism or espionage. Anyone who is deemed likely to engage in any subversive activity against the United States will be turned away when trying to enter into the United States.

  • Carriers of communicable diseases, including but not limited to AIDS, Tuberculosis and Typhoid Fever along with other transmittable serious ailments. Because carrying around a deadly or transmittable disease can create a severe health crisis, these individuals cannot legally enter into the United States.

  • Some immigrants have even been threatened with deportation due to not complying with criminal investigations in which they are a witness.

When you must address legal issues relating to Deportation Defense or other immigration law issues or disputes, we urge you to be proactive in ensuring your legal rights are protected and that you are treated fairly.
